Committee Status and Political Contributions

16. Organizational and Legal Status

Radwan Chowdhury for MD Progress is the campaign committee identified in the Agreement. The Committee may work with vendors, consultants, volunteers, professional advisers, payment processors, communications providers, and other persons or entities in carrying out authorized campaign activities. Nothing on the Website or in this Agreement creates a partnership, joint venture, agency, employment relationship, fiduciary relationship, or legal affiliation between the Committee and any third party unless expressly established in a separate written agreement.

Where a political communication, contribution, expenditure, fundraising activity, or other regulated activity is conducted by a separate political committee, organization, vendor, or legally distinct entity, that entity remains legally responsible for its own applicable obligations. No person should assume that a contribution, communication, record, or obligation associated with one entity automatically belongs to another entity.

17. Purpose and Scope of Digital Services

The Website and related digital services may support lawful campaign, civic, public policy, voter education, community engagement, volunteer, event, petition, survey, fundraising, advocacy, political communication, and election-related activities. Information presented through the Website may concern public policy, government, legislation, elections, candidates, public officials, community issues, and matters of public concern.

Political, civic, or policy statements may reflect the position of the Committee, the candidate, or an identified individual. A statement made by an individual supporter, volunteer, employee, consultant, or other person shall not automatically be treated as an official statement of the Committee.

18. Political Contribution Integrity and Compliance

Political contributions received through the Website may be subject to federal, state, county, or local campaign finance requirements. The Committee may require information reasonably necessary to establish contributor eligibility, identify the true source of funds, apply applicable contribution limits, maintain required records, process payments, issue receipts, and make required reports or disclosures.

Users may not:

  • Make a political contribution in the name of another person or entity;
  • Conceal or misrepresent the true source of a contribution;
  • Use another person as a conduit for a contribution;
  • Reimburse or arrange reimbursement for another person's prohibited contribution;
  • Circumvent applicable contribution limits or reporting requirements;
  • Provide materially false, misleading, incomplete, or fraudulent contributor information; or
  • Use funds or property that the Committee knows, or reasonably should know, are prohibited under applicable law.

The Committee may reject, refund, return, reattribute, redesignate, or otherwise correct a contribution when required or permitted by applicable law, including where a contribution is prohibited, excessive, duplicative, erroneous, unidentifiable, received by the wrong entity, or otherwise required to be corrected.

19. Foreign Nationals and Other Prohibited Sources

Nothing in this Agreement permits a contribution, donation, expenditure, disbursement, election-related activity, or political decision-making prohibited by applicable law. Where federal election law applies, the Committee will comply with restrictions concerning foreign nationals and other prohibited sources.

The Committee may conduct reasonable verification or request additional information where circumstances create a legitimate compliance question regarding contributor eligibility or the source of funds. Foreign persons may not use the Website or campaign systems to conduct election-related activity that is prohibited by U.S. law.

Where applicable federal law prohibits contributions from corporations, labor organizations, federal government contractors, foreign nationals, or other prohibited sources, the Committee will not knowingly accept such contributions.

20. Contribution Limits, Recurring Contributions, and Refunds

Contribution limits are determined by the applicable law, recipient committee, election, contributor type, and jurisdiction in effect at the time of the contribution. The Committee will not rely on a single permanent dollar limit where the applicable legal limit may change.

Where recurring contributions are offered, the authorization will identify the recurring nature of the transaction to the extent required by law or the applicable payment platform. Users may cancel recurring contributions through the available cancellation mechanism. The Committee will maintain reasonable procedures for processing valid cancellation requests.

Political contributions are not automatically charitable contributions and should not be represented as tax-deductible charitable donations unless such treatment is legally applicable.

Sections 21–30

Information Handling, Disclosure and Security

21. Donor, Political, and Voter Information

Information voluntarily provided to the Committee may reveal political interests, policy preferences, advocacy participation, volunteer activity, event participation, or support for particular issues. Such information may be used for lawful campaign operations, communications, volunteer coordination, events, fundraising, advocacy, civic engagement, compliance, security, and legal purposes.

The Committee may lawfully obtain or use voter and political information from governmental sources, public records, authorized political data providers, licensed vendors, or other lawful sources, subject to applicable election, privacy, contractual, and data security requirements. The Committee will not knowingly use political or voter information in a manner prohibited by applicable law.

Political information should not be understood to be anonymous when the Committee or applicable law permits or requires the information to be associated with an identifiable individual.

22. Government, Regulatory, and Legally Required Disclosures

The Committee may disclose personal, donor, political, communications, financial, or other information when reasonably necessary to comply with law or lawful process, including a subpoena, court order, government request, election law, campaign finance reporting requirement, tax requirement, regulatory requirement, audit, investigation, or law enforcement process.

Political and campaign records may be subject to mandatory retention, inspection, reporting, public disclosure, audit, or other governmental requirements. Where applicable law requires disclosure, the Committee will comply even where an individual would otherwise prefer confidentiality.

23. Data Sharing and Authorized Service Providers

In addition to the disclosures already described in the Agreement, the Committee may use authorized third parties for payment processing, email, SMS, telephone communications, event registration, volunteer management, website hosting, cloud storage, analytics, cybersecurity, compliance support, legal services, accounting, auditing, data management, and related campaign operations.

The Committee will seek to limit third-party access to information to legitimate, authorized purposes and, where appropriate, require service providers to maintain reasonable safeguards and use information only for authorized services. Third-party providers may have their own privacy policies and terms that govern their systems and services.

24. Payment Processing and Financial Information

Payments may be processed through third-party payment processors or fundraising platforms. The Committee may not directly store all payment card information. Payment information may be processed according to the payment processor's security practices, privacy policy, contractual requirements, and applicable law.

The Committee will not knowingly request or store payment card information through an insecure mechanism. Users should not submit full payment card numbers, account passwords, authentication credentials, or other highly sensitive financial information through public forms, comments, or other channels not specifically designated for that purpose.

25. Telecommunications and Electronic Communications

The Committee may communicate by email, SMS or MMS, telephone, voicemail, automated technologies, digital platforms, social media, direct mail, and other lawful electronic or physical methods. The Committee will maintain procedures designed to comply with applicable federal and state telecommunications requirements, including the Telephone Consumer Protection Act, applicable Federal Communications Commission rules, and applicable state requirements.

Consent to receive one category of communication does not necessarily constitute consent to receive every category of communication. Where consent is legally required, the Committee may obtain and maintain records of consent through website forms, volunteer forms, event registration, donation forms, SMS opt-in, email subscription, or other lawful mechanisms.

Users may opt out of SMS communications using reasonable available methods, including STOP or another legally recognized opt-out method where supported. Users may unsubscribe from nonrequired email communications using the available unsubscribe mechanism. Legal, transactional, security, compliance, or administrative communications may continue where permitted or required by law.

26. Data Retention and Records Management

The Committee may retain information for as long as reasonably necessary to provide services, maintain campaign and organizational records, comply with campaign finance and election requirements, maintain donor records, process transactions, resolve disputes, prevent fraud, maintain security, conduct audits, and satisfy legal or regulatory obligations. Where law requires longer retention, the Committee may retain information for the required period.

A request to delete personal information does not require the Committee to delete records that it is legally required or permitted to retain, including contribution records, financial records, election filings, communications records, evidence relevant to a dispute, security records, or other legally protected records.

27. Privacy Rights

Subject to applicable law, individuals may have rights concerning access, correction, deletion, portability, restriction, objection, consent withdrawal, or communication preferences. These rights may be limited or unavailable where the Committee is required or permitted to retain, disclose, or process information for campaign finance, election, tax, regulatory, legal, security, fraud prevention, recordkeeping, or other lawful purposes.

Nothing in this Agreement creates a privacy right that is not provided by applicable law, and no request for deletion, restriction, or objection may be used to defeat a mandatory political, financial, election, tax, or regulatory recordkeeping obligation.

28. Children and Minors

The Committee does not knowingly collect personal information from children under 13 except where permitted by applicable law or where information is collected in connection with a lawful activity with appropriate safeguards. Where a campaign, civic, educational, or volunteer activity involves minors, the Committee may apply additional safeguards appropriate to the activity and required by law.

Nothing in this provision prohibits lawful political participation by minors where applicable election law permits such participation.

29. International Users and Data Transfers

The Website may be accessible from outside the United States. Personal information may be processed or stored in the United States or other jurisdictions where the Committee or its service providers operate. Where applicable law requires additional safeguards for international data transfers, the Committee will seek to use reasonable safeguards appropriate to the transfer.

Nothing in this section authorizes a foreign national or other person outside the United States to participate in election-related activity in a manner prohibited by U.S. federal or applicable state law.

30. Cybersecurity and System Integrity

The Committee maintains reasonable administrative, technical, and organizational safeguards designed to protect information and the integrity of its systems. No electronic system, website, database, transmission, or storage method can be guaranteed to be completely secure.

Users shall not:

  • Circumvent or attempt to defeat security controls;
  • Probe, scan, or test systems without authorization;
  • Attempt credential theft, phishing, or unauthorized account access;
  • Introduce malware, malicious code, ransomware, or other harmful software;
  • Conduct denial-of-service attacks or otherwise interfere with infrastructure;
  • Access restricted databases, records, or systems without authorization;
  • Extract protected or restricted information through scraping or automated means;
  • Abuse bots, automated systems, or technical mechanisms in a manner that disrupts or circumvents the Website; or
  • Use the Website to facilitate cyberattacks or other unlawful conduct.

The Committee may investigate serious security incidents and may report suspected unlawful activity to appropriate authorities where permitted or required by law.

Sections 31–35

Conduct, Communications and Content

In addition to the prohibited conduct already stated in the Agreement, users shall not use the Website or campaign systems to commit fraud, impersonate another person, misrepresent political affiliation, threaten or stalk others, engage in unlawful discrimination, manipulate political or donor records, violate privacy rights, or knowingly facilitate election fraud or unlawful voter suppression.

Users may not falsely represent themselves as Radwan Chowdhury, Radwan Chowdhury for MD Progress, a Committee officer, employee, volunteer, consultant, agent, authorized representative, political committee, candidate, government authority, or other person or entity when no such authorization exists.

32. Political Communications, Disclaimers, and Election Information

The Website may contain political advocacy, policy positions, candidate information, endorsements, election information, fundraising materials, and other political communications. Where a communication is subject to a federal, state, county, or local disclaimer requirement, the applicable legally required disclaimer shall be used. Nothing in this Agreement replaces a disclaimer required on an individual political communication.

Nothing on the Website shall be interpreted as an official endorsement of another candidate, political party, elected official, ballot measure, referendum, or political organization unless the Committee or an authorized person expressly identifies it as an official endorsement.

Election information can change. Users should verify registration deadlines, eligibility, polling locations, early voting information, absentee or mail ballot requirements, election dates, and ballot procedures with the appropriate official election authority.

33. No Legal, Tax, Financial, or Professional Advice

Information on the Website is provided for general informational, civic, campaign, and public policy purposes. It is not legal, tax, accounting, investment, financial, immigration, medical, or other professional advice. Users should obtain independent professional advice concerning their individual circumstances.

34. Intellectual Property, User Content, and Third Party Material

The Committee's names, logos, trademarks, service marks, graphics, photographs, videos, documents, publications, policy materials, software, Website content, and other original materials may be protected by applicable intellectual property laws. Unauthorized commercial use, reproduction, distribution, modification, or exploitation may be prohibited.

If users submit comments, testimonials, photographs, videos, statements, ideas, event content, volunteer stories, policy suggestions, or similar materials, they represent that they have the right to submit them. Consistent with the original Agreement, the Committee receives a nonexclusive, royalty-free license to use submitted content for lawful campaign or Committee purposes, subject to applicable law.

The Committee may reference or display third-party material. The inclusion of a third-party link, statement, organization, product, service, or source does not necessarily constitute endorsement. The Committee is not responsible for third-party content, privacy practices, security, availability, accuracy, or terms of use.

35. Electronic Records, Consents, and Signatures

Where legally permitted, electronic agreements, contribution authorizations, consent records, acknowledgments, notices, communications, and electronic signatures may satisfy applicable requirements for written records or signatures. Users are responsible for providing accurate information and maintaining access to their accounts and communication channels.

Sections 48–60

Text, Voice and Email Communications

48. Mobile Text and SMS/MMS Terms

The Committee may operate one or more mobile messaging programs using SMS or MMS. A person who voluntarily provides a mobile telephone number and affirmatively opts in to a particular Committee messaging program may receive recurring campaign-related text messages, including campaign updates, event information, volunteer opportunities, advocacy messages, election information, and requests for political contributions.

Text-message consent is program-specific and does not, by itself, constitute consent to receive calls, prerecorded voice messages, voicemail, or messages from unrelated programs or third parties.

Consent to receive campaign text messages is not a condition of making a contribution, purchasing any item, registering for an event, volunteering, or obtaining any service.

Message frequency may vary based on campaign activity and engagement. Message and data rates may apply. Recipients should consult their mobile carrier for applicable charges.

Recipients may revoke SMS/MMS consent at any time through a reasonable method, including replying STOP, or by using another reasonable opt-out method made available by the Committee.

After a valid opt-out request, the Committee will stop covered recurring campaign messages within the period required by applicable law and its communications procedures.

The Committee may send one confirmation text after an opt-out request when permitted by applicable law. Any such confirmation will be limited to confirming the opt-out and will not contain fundraising, advertising, advocacy, or other promotional content.

Recipients may reply HELP for assistance or contact the Committee using the contact information stated in this Agreement.

Mobile carriers, including T-Mobile, AT&T, Verizon, and other carriers, are not responsible for delayed, failed, or undelivered messages.

The Committee will not sell, rent, or share SMS/MMS opt-in data, consent records, or related mobile information with third parties for their own marketing purposes, except where disclosure is required or expressly permitted by law or the recipient has provided the required consent.

49. Text Message Consent, Records, and Revocation

Where prior express consent is required for a particular text message, the Committee will use an affirmative opt-in process appropriate to the communication and applicable law. Consent records may include the telephone number, date and time of opt-in, source or form through which consent was obtained, applicable disclosure, program or sender identity, and subsequent opt-out or revocation activity.

The Committee will not treat the mere existence of a telephone number in a donor, volunteer, voter, event, petition, or other database as automatic consent for every category of automated communication.

Where a communication program requires written or electronic consent, the Committee will use a clear and conspicuous disclosure that identifies the type of communication, the telephone number or numbers covered, the use of automated systems or artificial or prerecorded voice where applicable, and that consent is not a condition of a purchase or donation.

The Committee will honor reasonable consent-revocation and do-not-contact requests and will maintain suppression records so that an opted-out number is not inadvertently re-added to the same messaging program.

Where a mobile number has been reassigned or the Committee has reason to believe that consent no longer belongs to the current subscriber, the Committee will take reasonable steps required by applicable law and its compliance procedures before continuing automated communications.

50. Federal TCPA and FCC Telecommunications Compliance

The Committee will comply with the Telephone Consumer Protection Act, 47 U.S.C. § 227, applicable Federal Communications Commission rules, orders, and guidance, and any other federal telecommunications requirements applicable to the communication being made. Political calls and texts are subject to different rules depending on the technology used, the telephone number called, the type of message, and whether an automated, autodialed, artificial, or prerecorded voice technology is used.

The Committee will not assume that political status creates a blanket exemption from federal restrictions governing autodialed calls, prerecorded or artificial voice calls, or automated text messages to wireless numbers.

Where prior express consent is required, the Committee will obtain and retain appropriate consent before initiating the covered communication.

Artificial or prerecorded voice technology, including technology that uses an AI-generated or simulated voice, will be treated as subject to the applicable TCPA and FCC requirements.

The Committee will maintain procedures for reasonable opt-out and do-not-contact requests and will process such requests within the period required by applicable federal law.

The Committee will not use spoofed caller identification or technology intended to conceal the true identity of the Committee or the originating caller.

51. Voice Calls, Autodialing, Prerecorded Voice, and Voicemail

The Committee may communicate by live telephone call, automated call, prerecorded voice, artificial voice, voicemail, or other telephone technology only in accordance with the requirements applicable to the particular communication. The Committee will distinguish between manually dialed live calls and calls using automated dialing, artificial voice, prerecorded voice, or voicemail technologies.

Where applicable law requires consent before an automated, autodialed, artificial-voice, prerecorded-voice, or prerecorded-voicemail communication is made, the Committee will obtain the required consent before the communication.

For prerecorded or artificial-voice political communications, the message will identify the Committee or other entity responsible for initiating the communication at the beginning of the message and will provide the required telephone number or other contact information during or after the message.

Where Maryland campaign-material rules apply, prerecorded political calls and related campaign communications will include the legally required authority line or other required sponsor identification.

Caller identification information will not be intentionally blocked, manipulated, or falsified. Where permitted and technically available, the originating number and caller name will be transmitted in accordance with applicable law.

The Committee will not use an altered or artificially disguised voice for the purpose of concealing the identity of the caller, defrauding, confusing, injuring, or unlawfully obtaining personal information from the called party.

The Committee will maintain reasonable procedures governing calling frequency and calling hours. For Maryland operations, the Committee may adopt the more protective 8:00 p.m. to 8:00 a.m. calling window unless campaign counsel confirms that a different legally applicable rule governs the specific communication. Federal restrictions, including applicable federal robocall quiet-hour requirements, will also be observed.

The Committee will not knowingly use ringless voicemail or other direct-to-voicemail technology to wireless numbers without the consent required by applicable federal law.

Recipients may request that their telephone number be removed from future campaign calling or voicemail lists. The Committee may maintain a suppression or do-not-call record to prevent future unwanted campaign communications.

52. Maryland Campaign Communications and Authority Lines

Because the Committee operates in Maryland and its communications may constitute campaign material, the Committee will comply with Maryland Election Law and Maryland State Board of Elections requirements applicable to campaign communications.

Campaign material distributed through websites, email, text messages, telephone banks, automated or prerecorded oral communications, social media, digital advertising, and other electronic media will contain the authority line required by Maryland law when applicable.

A political text message sent by the Committee to a potential voter or donor will include the applicable authority line within the message. If the character limit makes the complete authority line impracticable, the Committee will use the alternative procedure permitted by Maryland law, including an immediately following text that prominently displays the authority line when required.

Prerecorded or automated campaign calls and voicemail communications will be treated as campaign material and will include the required sponsor identification and authority information.

The Committee will retain copies or electronic records of campaign communications when required by Maryland campaign-finance law, including required retention of campaign materials and Internet-distributed materials.

The Committee will periodically review Maryland State Board of Elections guidance because authority-line, campaign-material, robocall, and digital communication requirements may be updated.

53. Email Communications

The Committee may send campaign-related email communications, including updates, event information, volunteer opportunities, advocacy messages, election information, and requests for political contributions.

Each campaign email will clearly identify the sender or Committee and will provide a reasonable method for recipients to unsubscribe from non-required campaign email communications.

The Committee will honor email unsubscribe and do-not-contact requests promptly and will maintain reasonable suppression procedures to prevent future unwanted campaign email.

The Committee will not treat an email address supplied for a donation, volunteer activity, event registration, petition, survey, or other purpose as unlimited consent to receive every category of email communication.

Where the CAN-SPAM Act or other federal or state commercial-email requirement applies to a particular communication, the Committee will comply with the applicable identification, opt-out, and other requirements. Political email that is not subject to CAN-SPAM will nevertheless be handled using comparable sender-identification and unsubscribe practices as a matter of Committee policy.

Campaign emails and email blasts that constitute Maryland campaign material will include any authority line or other disclosure required by Maryland Election Law.

The Committee may send transactional, legal, compliance, contribution-receipt, security, event, or other necessary administrative communications after a marketing unsubscribe where permitted or required by law.

54. Consent Is Channel-Specific

Consent for one communications channel does not automatically establish consent for another. An SMS opt-in does not automatically authorize automated calls or prerecorded voicemail. An email subscription does not automatically authorize text messages. A live telephone conversation does not automatically establish consent for automated or prerecorded communications. The Committee will maintain channel-specific consent and suppression practices where required.

A recipient may separately opt out of email, SMS/MMS, telephone calls, voicemail, postal mail, or other campaign communications.

The Committee may maintain a centralized preference or suppression system to honor a recipient's communication choices across applicable programs.

Where law requires a broader revocation of consent across communications from the Committee, the Committee will apply the legally required scope of the revocation.

55. Telecommunications Service Providers and Third-Party Platforms

The Committee may use third-party providers for SMS/MMS, voice calls, voicemail, email, payment processing, event registration, volunteer management, analytics, hosting, data management, and related campaign services.

The Committee will select and configure communications providers in a manner reasonably designed to support compliance with applicable federal and state law.

Providers may have their own terms, privacy policies, carrier requirements, registration requirements, sender-identification rules, or technical restrictions. The Committee may be required to comply with those requirements in addition to applicable law.

The Committee will not authorize a provider to use campaign communication data for its own unrelated marketing purposes when such use is prohibited by the Committee's Agreement, the provider contract, applicable law, or the recipient's consent choices.

Where required, the Committee may register messaging campaigns, telephone numbers, sender identities, or other communication information with carriers, messaging platforms, or regulatory systems.

56. Accessibility and Language of Communications

The Committee will make reasonable efforts to ensure that campaign communications are accessible and usable by recipients, including through reasonable accommodations, alternative formats, accessible web content, and language-access practices where appropriate to the communication and applicable law.

Where a recipient communicates an opt-out, consent withdrawal, or other preference through an accessible or alternative channel that the Committee reasonably recognizes, the Committee will process the request in accordance with applicable law.

Accessibility or language assistance does not change the legal requirements applicable to consent, campaign disclosures, authority lines, or opt-out requests.

57. Communication Compliance Records

The Committee may retain records of campaign communications and related compliance activity, including consent records, opt-in forms, opt-out requests, suppression records, phone numbers, email addresses, communication dates, message content, authority-line versions, provider information, delivery records, complaints, and compliance reviews, for periods reasonably necessary to establish compliance and satisfy applicable legal, campaign-finance, audit, dispute, or record-retention requirements.

A recipient's request to delete personal information will not require deletion of consent, opt-out, suppression, campaign-finance, legal, or compliance records that the Committee is required or permitted to retain.

The Committee may use retained suppression information solely as reasonably necessary to prevent unwanted communications and maintain compliance.

58. No Guarantee of Delivery

The Committee cannot guarantee that any email, text message, telephone call, or voicemail will be delivered, received, displayed, or delivered without delay. Delivery may be affected by carriers, service providers, spam filters, device settings, network conditions, number reassignment, platform restrictions, technical failures, or other circumstances outside the Committee's control.

59. Communications Disclaimer and Legal Review

The communications provisions of this Agreement are intended to establish the Committee's compliance practices and are not a substitute for legal advice. Federal and state telecommunications, campaign-finance, privacy, carrier, and electronic communications requirements may change. The Committee may update its procedures, consent language, opt-out mechanisms, authority-line formats, and vendor requirements as necessary to comply with current law.

The Committee will consult qualified campaign-finance, telecommunications, privacy, or other legal counsel when a proposed communication presents a material or uncertain compliance issue.

60. Supplemental Contact for Legal, Privacy, and Compliance Matters

Effective as of the date of the most recent revision of this Agreement.

Questions, requests, notices, or concerns concerning privacy, legal compliance, campaign finance, cybersecurity, intellectual property, or communications may be submitted using the contact information provided in Section 16 of the original Agreement. The Committee may designate additional legal, privacy, compliance, or security contacts from time to time.

This Supplemental Legal & Compliance Addendum is incorporated into and forms part of the Privacy Policy, Terms of Use, and Acceptable Use Policy of Radwan Chowdhury for MD Progress. It is intended to strengthen and clarify the existing Agreement by adding legal, privacy, campaign finance, communications, cybersecurity, records, and operational protections. Except where this Addendum expressly supplements or clarifies an existing provision, all provisions of the original Agreement remain unchanged and in full force and effect. Nothing in this Addendum is intended to authorize conduct prohibited by applicable federal, state, county, or local law.
